Licensing, Age Verification, Flavor Bans, Oh My!

Vape companies are now surrounded by an ever-changing and ever-growing legal landscape. Here's what you need to know to navigate it successfully.

As a vape company owner or operator, you have probably heard about the Preventing All Cigarette Trafficking (PACT) Act expansion by now to include Electronic Nicotine Delivery Systems (ENDS), which created a whole series of new regulations that online vape retailers have to abide by at the federal level. What you may have forgotten is that before the expansion, regulations were being enacted in various jurisdictions that still stand to this day. Additionally, jurisdictions have continued to enact new regulations in response to the PACT Act. And some of these new regulations are even more strict than the PACT Act itself.

How do you keep track of all of this and comply with all of the various regulations across the country? You could try to hire a compliance manager and/or team to do the research and change operations in-house, but hiring and training takes a ton of time, effort, and investment. You could just ignore it and proceed as if it’s the Wild West, but the risks and costs associated with non-compliance could cause you to lose your business. Because of this, most online vape retailers and wholesalers have turned to contracting compliance partners to help, but have found that they require a partner for each issue and some of the partners have been unable to deliver. Token of Trust seeks to change that.

While we cannot cover every single compliance issue online vape retailers and wholesalers face, we offer a bundle of solutions to help reduce your partner list and stay compliant with the ever-changing regulations across the country. Those solutions include:

  1. An Age Gate, for people to self-proclaim they are of legal age to view the products in your online store;
  2. Age Verification at Checkout, to ensure you are only selling to customers who are of legal age to purchase them;
  3. PACT Act Reporting, which offloads tedious monthly reporting of sales to each state to save you and your team time; and
  4. Excise Tax Collection and Reporting, which can help protect your margins by calculating the excise tax for each order in real-time and collect it from the customer as they pay for their order as well as save you time by generating the reports required for each jurisdiction in each jurisdiction’s preferred format and per each jurisdiction’s reporting cadence.

In addition to these services, we work with so many B2C and B2B vape companies that we have developed a network to keep everyone up-to-date on the latest regulations and requirements and connect businesses with valuable partners for the other compliance requirements and to expand their business. To get you started, here is a matrix of some of the state-by-state regulations to keep in mind as you operate your business, available for free download.
